Legal Question in Family Law in Kansas

Elderly Abuse

My 90 year old mother is in the care of my older brother, who is bleeding her dry and not giving her good care. Now he won't allow us to see her and went so far to take away her phone, If we want to talk with her we must go through him. There are 11 other brothers and sisters who wants our Mother removed out of his home and in a nursing home to where she will receive good care. How can we do this?

Re: Elderly Abuse

If your mother is being abused or neglected, the police and SRS should be notified. You did not say under what authority your brother is acting. Does he have a Power of Attorney? A guardianship proceeding should be filed in the county where your mother lives. If there is already a guardianship, a Petition to Change Guardian should be filed by the family.

Re: Elderly Abuse

You should file a petition to have someone appointed her guardian. I would also call the police.
