Legal Question in Family Law in Kansas

File for Divorce When Spouse Whereabouts Unknown

I have been separated from my spouse for over 1 1/2 years. I would like to file for a divorce but I do not know her current address or have any idea of where she is at. There's no property to be divided or children to be considered. How can I file without the involvement of an attorney?

Re: File for Divorce When Spouse Whereabouts Unknown

You must make a diligent search, contact former employers, family and friends for her address. Keep a record of what you do. If you cannot located her, then you can file the petition for divorce and then serve through "publication." Which requires you to publish notice of the petition in a paper of general circulation in the county of the court in which you are filing, for a statutory period. Present evidence of the publishing and allow 30 days for an answer, and ask the court for the divorce decree.
