Legal Question in Family Law in Kansas

I am filing for divorce and the children I have are not his. There has been a paternity test to prove they are not his and he did not sign the birth certificate and they do not have his last name. Do I need to file a divorce with children?

In Kansas, there is a presumption of paternity that the Husband is the father when children are born during a marriage. That presumption will be overcome when you file a Petition for Divorce stating no children were born of the marriage and that is supported by the genetic tests.
