Parental Rights

I have sole custody and haven't seen or heard from my ex husband for three years. I'm living with someone now and he wants to get married and adopt my daughter. How do I get my ex husband to give up his parental rights if I don't know where he is? And do I need him to or can my new husband just adopt her.

One would need to file an adoption petition, giving notice by publication to the natural father if one does not know where he is. However, one would have to demonstrate that he cannot be located. The standard to terminate his parental rights is unfitness. It should be possible to complete the adoption process without too much trouble.
