Legal Question in Health Care Law in Kansas

A nurse from the office of my primary care physician has knowingly and intentionally disclosed my patient information to a third party not associated with her office or me. The disclosure included very sensitive and personal information regarding an abortion. I went in to the office discuss this with my physician. She has apologized and has fired her employee. She told me to "make her an offer". She does not want to be sued. I am not sure if this is a HIPAA violation or if that even matters. What is a ballpark dollar amount that I should present? Or should I just obtain the services of an attorney and sue her.

It is nearly impossible to assess the specific value of a HIPAA violation with generalized facts. You may have an attorney help you evaluate the value of the damage to you, without making the dmenad for you or filing suit. This limited representation is usuually much less than the cost for full representation and may be worth the added value to you in settlement.
