Legal Question in Immigration Law in Kansas

My friend (from Mexico) lived in Kansas, USA with her husband from unknown time, until their son was 3 or 4 years old. Her husband left them and they moved back to Mexico with her parents. in Dec 2009 she sent her 15 year old son back up to Kansas to live with his uncle (her brother) to make a better life for him. Since he was a UIS citizen this was no problem. She now wants to come to Kansas also but her brother may not file Family Fourth Preference. Is there another way she can come up here? There is not any other relatives except her 16 year old son. I am willing to help her and her son be together in any way I can.

Your friend could either try to re-enter the U.S. under some type of employment based visa or under Asylum if she fears persecution in Mexico.

But until her son turns 21 years she would not be able to enter under family based visa.
