Legal Question in Medical Malpractice in Kansas

What is the timeframe I have to file a malpractice claim?

I was permanently injured during surgery by a local surgeon but did not file a claim at the time of the incident as I was having mental problems and was applying for disability which was a set back in my filing this claim. Is it too late to file this malpractice claim?

Re: What is the timeframe I have to file a malpractice claim?

In Kansas, the normal Statute of Limitation for a medical malpractice claim is two years from the date of the surgery. There are some exceptions to this rule, which must be evaluated by an attorney after all facts are known. Do not delay in having the claim evaluated. If the Statute of Limitation expires, the claim will be forever barred.
