Legal Question in Medical Malpractice in Kansas

i had my wisdom teeth removed 6 weeks ago and my jaw was broken. no follow up care was given even though i went back several times complaining of heavy pain. i just found out today that my jaw was broken because i went to a differant dentist to get a second opinion and they took and xray and found the broken jaw. my question is who is liable to pay for the bill to have it repaired as now it is going to be major surgery to get it fixed me or the dentist who broke my jaw? thank you

Although jaw fracture is a known complication of wisdom tooth removal, the occurrence is usually due to negligence on the part of the oral surgeon. It will be necessary for you to have your records and x-rays reviewed by a specialist to get a written opinion as to whether the standard of care was breached. If negligence is apparent, a claim could then be made against the negligent treatment provider and his or her professional liability insurance company.
