Legal Question in Personal Injury in Kansas

I was recently involved in an automobile accident. I was the only car involved. The accident was caused because my lug nuts weren't tightened on one of my tires after I had gotten a balance and rotation. I had the service done on the Monday before the accident, approximately 18 hours prior to the wreck. About 1 hour after I had the service done, I called the business in question and advised them that my car was shaking violently while travelling down the highway. At that time, their associate advised me that one of the weights must have come off my car and that it is safe to drive. I was advised to bring it back at my earliest convenience and they would re-balance my tire. I went home and the next morning is when I was in the accident. I was travelling at approximately 40 mph when I lost control of the vehicle. I hit my head and injured my back when I hit the ditch. The best case scenario is that my back is only sprained. The worst case scenario is that I have a pinched nerve or damaged disk from the impact. The companies liability insurance has so far been handling everything in a fairly timely manner. They towed my car to the repair shop of my choice, they have rented me a car to drive in the interim. My question is this: Should I get an attorney? I'm not looking to get some sort of windfall out of this accident, however, the more I think about how I could've died or how it could've possible happened to someone who had children riding in the car makes me feel like the company in question needs to be held responsible for more than just my car repairs and medical bills. Please advise as to what I should do next. Your answers and responses are greatly appreciated. Thank you.

You should consult directly with anb attorney in yrou area, who can view all the records and other documents of yoru case, and give you specific advice as to your legal options. It would be almost pure speculation to assess yoru position and options, given the few facts you can provide in this forum. Many attorneys offer free or low fee initial consultation.

I advise you to consult with a personal injury attorney in the state in which the accident occurred. The company should be liable for your medical bills, past and future; your lost wages, past and future; and your pain and suffering (non economic damages). THe company's insurance carrier will not treat you fairly. Its only goal is to pay as little money as possible. Find an experienced attorney. Most personal injury attorneys, like our firm, will not charge your to consult with you about your alternative.

Consult an experienced personal injury attorney regarding your rights. Your recovery will depend on your actual medical expenses and other damages such as lost wages and pain and suffering. Save any photographs and paperwork from your vehicle repair. Please note that if the matter is not settled, any lawsuit arising out of the accident must be filed prior to the expiration of the applicable Statute of Limitation. Otherwise, it will be forever barred.
