Legal Question in Personal Injury in Kansas

I was returning to my car in a Home Depot Parking Lot with a cart full of lawn supplies. As I turned to open my car the 'cart' rolled into a patrons car and made a dent. The 'cart' Iwas using had no safety brake. The store had no policy posted regarding responsibilities of transporting goods to your car.

The patron's insurance company says that I am at fault and want me to pay the damages ($1,500).

Am I responsible or is Home Depot?

If the cart was broken or otherwise malfunctioning, Home Depot may have some liability. If the cart simly was neve manufactured wiht abraking mechanish, the liability of Home dpot may be harder to establish. As this occurred while you were loading your car, your liability insurer may cover the other driver's damges.
