car damage from accident

I was involved in a car accident where as the other driver was issued a failure to yield I filed a claim and the other driver first said he would pay out of pocket through his insurance rep now they are denying my claim.

Many insurers almost always deny your claim at first. They want to intimidate you into "accepting" a small amount as a favor or nuisance pay off. Do not accept their first offer to pay. It is almost always less than what they think you deserve. Some insurers are honest and fair companies. Apparently, you have gotten hooked up with one that is not. Now you see why many people hire counsel to deal with the other driver and their insurer.

It would be a good idea for you to consult with an insurance/ personal injury attorney. The attorney will be able to gather the information necessary to identify all sources of recovery available. Also, if the at fault driver's denial is effective, you may still be able to file an uninsured motorist claim if you had insurance.
