Can I choose the Surgeon

I'm in Kansas with a RSI Cervical Buldging discs injury, can I choose the Surgeon or must it be done by Work Comp Insurance and/or the Judge? If I can pick my Surgeon, must he be a Workers Compensation surgeon?

Under Kansas comp law, the respondent and insurance carrier have the right to pick the treating doctors. You have up to $500 available for a second opinion. If, after treatment begins, you are dissatified with the treating doctor with some reason, you can ask the Judge for a Change of Physician. The JUdge will then usually order the carrier to give you the names of 3 docs to choose from.

This is full of pitfalls for the claimant. For such a serious injury, I suggest you hire an attorney. Contingency fees are set by state law. You will be money ahead. Good Luck
