Legal Question in Consumer Law in Kentucky

New Automobile Lease Contract

I leased a new 2002 auto on May 18, 2002 for three years. I participated in the advanced payment program, meaning I paid for the entire 3 year lease in one lump sum payment as spelled out in the contract. Now, two weeks later, after my check has been cashed, they said they gave me the figures for a two year lease and they want me to come in and resign a new contract paying more money. Do I have to do that?? Also, they were to fix a part on the auto that had a dent in it. The part is now in, but i am scared if I bring it in to their service department they will keep it.

Re: New Automobile Lease Contract

It's going to depend almost entirely upon what yoru lease paperwork says. This is a contract situation, and contracts are construed against the party drafting the contract, in this case the seller. If the contract says three years and describes the payments in full, you've got a very good case to enforce the agreement. There may be unjust enrichment issues to deal with, but i'd make them sue you. Go pick up the part and have another dealer/mechanic repair the car. Good luck.

Re: New Automobile Lease Contract

i would need to review your lease, but it would appear to me that if you bargained for a three year lease then that is what you should have. please feel free to contact me directly for a consultation if you desire.
