double jeopardy

there was a 25 year old found to have been with my 14 year old he was tried and pleaded guilty for sexual misduct with a minor now new evidence has came to our attention through a rape kit that there was more then misconduct. There was also drugs (pot) found in my daughters system she says he tried forching his hands in her pants but nothing else the doctor claims she is still a virgin but the evidence is sperm in her on her panties they are saying he can not be retried due to new evidence what are my legal rights to make sure this guy does not do this to someone elses daughter he is known to run with young girlsmy daughter claims all she remembers is him trying to forch is hands in her pants nothing else please help me

If there were separate occurrences, not previuosly adjudicated, to have been alleged, he could be charged with rape.
