Re: Persistent Felony Offender

A prosecutor generally has the discretion to recommend that the Court amend or drop any charges he or she sees fit in the course of a plea negotiation. Hoever, the final decision on whether to amend or dismiss certain charges is with the Judge. Usually, the courts I am familiar with will follow the recommendations of the Commonwealth. Please keep in mind that the Judge where your charges are pending does not have to accept any plea offer that the Commonwealth recommends.
