theft of Identity

I rexieved a summons for Identiy theft. It appears that My ex-husband recieved a bill from a comapny and I was the first to be suspected. I recieve mail with his name and my address from time to time. Is it possible that this company got my adress the same as these other companies. I have and would never use his name to obtain credit I have a better credit rating any way. and what should I expect at court? should I keep some of the mail I receive to prove that others have used this address. It seems it followed me from our married address.
