Legal Question in Family Law in Kentucky

Age limit for children of divorce couples

I divorced and have fullcustody of my two minor children.I let them go stay the summer with there dad and now they say that they want to live with him. Are they old enough to make that decision or do I have to right to say no. Also there dad said he talked to

a lawyer and the lawyer had the girls talk to social sevirce and that they were going to come and visit me which is fine. I have nothing to hide at all.I a good mother and can prove it and they have a wonderful. But they are now 12 and 15. Can they make that choice and I have to go by it or should I let him take me to court? They say they really want to live with there dad today. But just a week ago they did not. And the middle child lies all the time and it is hard telling what she told the social worker if they did talk to one. Now that I told there dad that he could have them if that is what they really want he says he will call them and tell them not to come. I just want my children to be happy.

Thanks

Re: Age limit for children of divorce couples

In Kentucky, there are several factors which affect where the children live. The Court's focus is always on what is in the best interest of the children. One of the factors that the Court will consider is the wishes of the children, but the law does NOT allow the children to choose. So, the children never get to just pick where they want to live. If you think it is in your children's best interest to continue to live with you, by all means, go to court.
