Changing last names

My son is 2 y/o and me and my x husband are divorced and i have had another child with another man and we are going to get married do i have the right or can i change my 2 y/o last name to my new married name. the father of him doesnt pay child support or do anything for him as far as seeing him or anything?

If paternity has been established, the father has to agree to the name change regardless of whether he pays child support.
