Child protection

I have a 24 yr old niece and her 3 yr old living with my brother & his wife. My niece does not work & is not caring for the child. She is also involved with drug use. My question is, If my brother were to kick her out & tell her they are keeping the child. What can happen to my brother? What ground do they have to protect the child. My niece does not have any money & has been using the child as her meal ticket. Can my brother be arrested and then what? Where does the child go? We want to protect the child and get the drug use out of the house. What rights does my niece and my brother have?

I would suggest that you call Child protective services.

If mom is unwilling to allow responsible family members to care for child,

legal action must be initiated to allow child

to be placed in relative placement - just

kicking mom out and assuming parental authority would be risky.
