Legal Question in Family Law in Kentucky

Do child support payment have to be made?

I was pondering if, the parents of an unborn child agree on the terms that one parent waves his or her rights to the child, in agreement to the other not paying child support and signed a contract stating this, if the contract can be up held in the state of kentucky, or does the state of kentucky up hold the legal issue and dismiss the contract and assume charges of child support payments.

It is almost impossible to give a good answer here. Generally, Kentucky Courts have a policy of requiring support from parents. You have a problem not only in Domestic Relations law but in contract law. The contract problem centers around consideration-"what is the mother getting out of this?" The other problem is the fact that the child is unborn and that presents an "Unknown" element here. I can mention other problems but the bottom line is that this type of contract is not looked upon with favor. Each one will be reviewed in light of each individual set of facts and circumstances. If I were you, I would speak with an local attorney who is more familiar with local policy and can ask you questions one on one to refine his/her answers.
