Custody Change

My ex-wife and I have Joint Custody of our 8 Year old son. We have been divorced for 4 years. For the first 3 years my son was with me at least 80% of the time. However over the last 7 months, my son has lived with me 100% of the time. His mother very seldom wants to spend any time with him, and this breaks his heart. Out of a possible 3984 hrs he has lived with me she has spent a total of 161 hrs with him. He refuses to spend the night with her period. He gets a check from my disability claim, and she now gives the check to me for support,only after she spent it for 5 months on herself ( he was with me ) She goes 4-5 days at a time without even calling him.

What are my chances of getting full custody of my son. Can my son tell the judge who he wants to live with.

As long as you have solid documentation of all of this (calendars/diaries/voicemails/emails/etc.) then I think your chances are very good. I'd definitely file the appropriate motions before the court and get the matter heard. Best of luck.
