Custody of a Child that was dropped off at my house- no relation to me

I have had a child in my home for almost a yr. The mother left the child with me and has not tried to contact us. The father is not paying anthing toward the child and will be going to jail on drug charges. How can I get rights to custody and also rights to take the baby off on my taxes?

It depends on the age of the child. If the child is under 3 years of age, then you could presently be deemed a de facto custodian by a court. Three years of age and older, then it takes a year of providing the primary care and primary financial support of a child to be deemed a de facto custodian.

If you qualify as de facto custodian as described above, then you can file a petition with your county's Circuit Court for custody. Custody issues are tricky though and so you would be better off at least consulting with a family law attorney before you file.
