Legal Question in Family Law in Kentucky

Question about disability and divorce

I am on Social Security Disability and my wife is asking for a divorce. She makes tons more than I do and we own a house and commercial property with a veterinary clinic on it. I realize that I will have to pay child support out of my 1280.oo a month SSD income. $400 of that is for the children. I will not be able to support myself with what is left. What do you think thelaw entitles me to under this case ?

Re: Question about disability and divorce

The answer to your question depends on many factors: length of marriage; relative incomes; history of income; needs of adults/children; living standard. I cannot, nor can any attorney give you an answer here with the small amount of information that you are limited to here. Only an office consultation where the proper facts can be developed can begin to lead to a resolution. Things may not be as dark as you envision them to be. See an attorney who does family law. You may not be charged for an initial consultation.

Re: Question about disability and divorce

From your zip code, it appears that you are in Jefferson County. The Family Court in Jefferson County requires full disclosure of all assets and liailities, and the judges generally divide assets 50-50, or close to that, if the parties cannot come to an agreement on their own as to how to divde their assets. Child support is determined by a table which draws on the income of both parents and determines the pro-rata share of each. There is far more to consider, and the best thing is to retain counsel to explore how to best address the many issues inherent in a divorce. Best wishes.
