Legal Question in Family Law in Kentucky

Seperated from wife

My father in law is still married to his last wife but has been seperated for 12 years or more. He has recently been in a fire and is on a form of life support. Does she have any rights in terminating life support or would this fall to my wife and her brothers?

It is not possible to answer your question without knowing if your father-in-law executed a Health Care Surrogate document, and if so, to whom he delegated this authority. If there is no such document, Kentucky law (KRS 311.631) gives the following order of responsible decisionmakers: court-appointed guardian, spouse, adult child .... If you fear the separated spouse may take action against the wishes of your wife & her siblings, you should make the hospital & doctors aware of the lengthy separation.
