Legal Question in Family Law in Kentucky

summer visitation

I am suppose to get 3 weeks of extra visitation with my daughter during the summer. My question is, is that suppose to include the regular weekend visitation that I have normally? For example, if she is with me for my weekend, starting on Friday, does my extra week visitation end on the following Friday or the following Monday, giving me a whole week of extra visitation?

Re: summer visitation

Ah - an unanswerable question. This is why it is important for lawyers to think down the road in drafting agreements so as to prevent these dilemmas.

The most reasonable take on it would be that if it starts on your weekend, then it would end on Friday so as to include your normal weekend visits within it (no make up weekends). You would have 2 of your regular weekend visits occurring within the 3 weeks.

If it starts on a Monday following a non-weekend, it should run through Monday. But, this is my reading and a judge may read it differently.

Unless you have extra money lying about that you wish to give to an attorney and a burning desire to aggravate your ex-spouse, then I would suggest just trying to talk it out and compromise. Maybe every other summer you get an extra weekend.
