unwed father

My son was not notified that custody was changed for his son. They had my phone number to get in touch with him. The maternal grandmother has temporary custody. My son was in the process of establishing paternity, Dna was done and he is the father, but because the mother divorce was not final, her husband was declared the father. What can my son do and since she was under social service investigation, does my son have the right to custody,until the court makes their decision about custody of the mother?

He has the right to pursue custody and should take action to this end very quicklly. Once the child has been in the temporary custody of the maternal grandmother for a certain period of time (1 yr if older that 3 or placed by the Cabinet or 6 mos if 3 and under) then she can gain equal footing with the natural parents regarding custody.
