Legal Question in Medical Leave in Kentucky

Completing FMLA forms

When completing FMLA & disability forms I have been told that c-section biths can only be completed for 6 weeks for postpartum recovery which is the same as a vaginal birth. I was told it would be fraudulent to complete c-section for 8 weeks. Please advise.

Re: Completing FMLA forms

There is no set time for FMLA with regard to a leave following a c-section delivery. It is within your physician's discretion. However, the insurance company handling the STD claim could deny your claim, if most individuals who have a c-section delivery are able to return to work within 8 weeks. In that case, you will need to demonstrate why your situation is outside the norm.
