Legal Question in Wills and Trusts in Kentucky

legal heirs

My husband passed away in 2005. He had no will. We have two children. His mother died in 2007 and his father just passed away. In their wills everything is passed on to their four children one of them being my late husband. Will his share go to just my kids or all three of us?

Generally, speaking, without seeing anything, it appears you are not an heir and would not receive a share either way. If the share was to his children, per stirpes, then it goes to the grandkids. If it goes to the children, per capita, then the children are cut out altogether because the estate would be divided to the surviving children.
