Legal Question in Consumer Law in Kenya

Travellers Cheques and Refunds

Is it possible to need legal aid to get someone like American express to refund the remaining funds from travellers cheques bought from american express. They were stolen in the United States, but i am travelling in Kenya, Africa. Its imperative i get assistance in some form, especially for duress caused by the delay of the rest of my refund. Sincerely.

Re: Travellers Cheques and Refunds

You exchanged US currency for American Express and at that time signed a contract. Amex is bound - as are you - to the terms of that contract. If Amex is not honoring their contract then you can compel them to do so. However, generally Amex has the right to withhold part of the replacement checks to offset any checks which you may have used.

Yes, I agree that they are bound by contract. But, that doesn't solve the problem of immediacy. You need to negotiate with them and keep a cool head. Remember: they have the money, you need the money. There should be someone who can handle emergencies like this, because an in-court action isn't going to help you. Most legal aid orgs are not going to be able to help you. Make sure you have complied with all the requirements,--they may require that you have filed a police report, even from Kenya, so make sure you've done everything you needed to do.
