Legal Question in Family Law in Kenya

Divorce question?

To whom it may concern,

My friend needs some help with a divorce? She went to Kenya 3 years ago and had got married. She is trying to get a divorce from the person. But was told by a lawyer in the U.S. that she needs a lawyer that is located in the country that she was married in. Is it possible to perform this without traveling to Kenya, from the U.S. ? The man she married lives in Kenya, and she lives in United States. What is the cost of this process, and how long will it take? She is looking for this to happen as quick as possible. Any help or direction would be greatly appreciated.

In theory at least, your friend brought the marriage here when she came to Massachusetts. If she has all of the necessary proof that the marriage was legally contracted in Kenya, she should be able to obtain a divorce here.

The difficulty is that she will have to obtain service on a party in Kenya. If she cannot get in-hand service of the papers, she may not be able to obtain the jurisdiction she needs here. In addition, regardless of the divorce's legality in the U.S., Kenyan law might theoretically refuse to recognize the legality of the Massachusetts/US divorce. On that, I have no information, and cannot give an opinion one way or the other.
