Legal Question in Bankruptcy in Louisiana

Forclosure in Louisiana

I live in new Orleans and behind on my house payments. I purchased a house from a private investor and no banks were involved. I am three notes behind and seller is threatning to start forclosure process. How long do I have before he is actually able to get the house back. The house for sale now but not having much luck. Please advice!

Re: Forclosure in Louisiana

The foreclosure process takes upwards of three months from the time you have been served with the Notice of Seizure, which is the first step in the process. The second step (from your perspective)will be the Notice of Sheriff's Sale, which is served some 4-6 weeks later. If you are served, you would do well to consult a bankruptcy attorney regarding your rights and responibilities. Note that you do NOT have to be out of the house three days after you are served with the Notice of Seizure. However, you must be out by the time the sheriff's sale actually takes place.
