Can I sue MY Lawyer?

My husband and i aquired a lawyer on 12/10/03. We paid upfront a flat fee for his services for joint custody and child support. Since then He has not taken care of the child support, my husband has been threatened to be taken to jail for a court apperance he was told to not go to by his attorney but was supposed to go to. My husband was sent a supoena for a intake hearing on his custody case in Feb. once again he was told not to go... His attorney has not returned our phone calls. We have tried not to be pests but a childs well being is hanging in the balance here. So as of April 14th, 2004 we still have no results not even a phone call.. what should we do. Can we sue him for our money back , he has not properly represented us.. and as far as we know he has not even contacted the other attorney on our behalf. We feel as that his work ethic lacks, he cares nothing about his clients, and he does not return phone calls. We sure feel like he is not trying to earn the money we paid him to take care of these matters. When we try to take time out of our schedules to make an appointment, he will conveintly be out of the office and we are not allowed to make an appointment until a week and a half or two weeks later. PLEASE HELP!

Leave a message at your Lawyer's office that if he does not contact you within, (you decide the time) otherwise you will go to the bar association......if he does not contact you, or if his explanation is not sufficient, then go to the bar association.........BUT, before you do that, contact another attorney and hire him to protect your husband's rights regarding his child. Louisiana bends over backwards for joint custody orders, so it should not be that complicated, keeping in mind that joint custody still names one parent as the domiciliary parent and the other has visitation rights.

Contact the Louisiana Bar Association and tell them of your concerns. They will help you from there.
