Legal Question in Consumer Law in Louisiana

In June of 2007, I saw an Acura NSX on ebay and classyautos.com listed for sale in Elk Grove, Ca for $42,500. I got the sellers phone number off the classyauto site and over the course of a month I negotiated with him.

On about June 20,2007 we agreed that he would sell me the car for $32,500. The seller is a policeman in Sacremento so I assumed he would not be a problem. I sent him the money, $8000 check form my personal account and a $24500 from my credit union.

I paid almost $2000 dollars to have the car shipped here and it arrived on July 4, 2007. The problem arose when the car was en route to my home in Baton Rouge, La. The owner called me and the trucking company and said he wanted his car back b/c he sold it to cheap.

To make a long story short the trucking company refused to bring his car back and dropped it off to me as the seller had cashed my checks. Me and my credit union have called the guy for 3 years and he will not provide me with the title.

I have a BEAUTIFUL car sitting outside under a cover depreciating, and I am almost done paying it off. In my opinion this is no longer a civiel matter. I want to be made full at this point and I want to have him arrested for fraud, interstate mail fraud, etc.

I have lost $1000s paying insurance , interest on the loan, depreciation, plus the car is sitting there rotting. I am pissed. What should I do. I called the California DMV and they told me that since I have no bill of sale, it is a civil matter. Interestingly, he did go to the Ca DMV and sign a release of liability on the car?

You need to sue him in California. Find a lawyer there.
