under age sex
My son is 19 and he had consential sex with a 15 year old. Her and her mother will sign legal papers stating they don't want him prosecuted for it. They want my son to press charges on the stepbrother(and stepson) for beating my son. Okay, can the stepdad, who is the only one on his son's side, use that against my son and have him thrown in jail for having sex with his stepdaughter even though her mom doesn't want him prosecuted? The stepbrother was mad at my son and that is why he and his friend tortured and beat my son. This is so horrible.

The district attorney, not the mom, the stepdad or the 15 year, has the final say if charges are accepted or not. You need to speak with the DA. You still have not said how old the step-brother or his friend are. The criminal charges and civil suits are separate things and not dependent on each other. Your son could be looking at some serious charges if the DA decides to proceed. Consent has nothing to do with it when she is 15 years of age.
