Legal Question in Criminal Law in Louisiana

Rape of An Adult by a Minor

A member of my church (a 28 year old male) told me he had been raped by another 15 year old male in our church. The 28 year old male is emotionally and socially handicapped. He lives with his mother and is able to work. She is not his legal guardian. He is too ppor to afford legal help. He wanted to report this to the police, so we reported it last night. The police turned the situation around (because of the victims age), read him his rights, and informed him of an impending investigation of an 80 (carnal knowledge of a juvenile). It is obvious to me and the rest of the church staff that the victim felt forced to have sex with the 15 year old, but we don't know what we can do. The victim has mental health records that we are going to pick up Monday morning, and we believe they will reveal that he is not considered to be over 18 emotionally. Thank you for any help you can give us.

Re: Rape of An Adult by a Minor

I believe that if this 15 year old boy was that aggressive against a 28 year old, then I bet with a little investigation you could find more boys that this boy molested. Afterall, no matter the mental age, the victim still possessed the body of a 28 year old, so this boy must be pretty violent. Go to the District Attorney in your jurisdiction. If they have an assistant DA who handles child molestation and rape, that would be better.
