Legal Question in Criminal Law in Louisiana

Wrongly Accused

My son and three others were wrongly accused of unlawful entry and assault on another teenager. We have proof that all kids were at home during the time of the assault, but the mother believes her son. The kids were not even together. Is there any kind of counter charge that we can press against the person for false accusation or anything else?

Re: Wrongly Accused

You do not say whether the police have become involved or if your son was arrested or detained for questioning. If the police are involved, then

the complainant can be charged with filing a false report and possibly other criminal law violations depending on the facts. Your son may also sue for any damages he suffered as a result of the false report. That would include libel/slander since intentionally accusing someone of a crime is slander.
