Legal Question in Family Law in Louisiana

Back Child Support for a Non-Married couple.

I dated a young woman in high school. The girl, at the time was promiscuious. She became pregnent and I was thought to be the father. Nothing was done, no marrige no child support was paid. Now after 30 years the mother and child requests a DNA test to determine if I am the father. Will I have to pay back child support if it is determined that I am actually the father of this child? And how long will the court go back if I have to pay.

Re: Back Child Support for a Non-Married couple.

In Louisiana, you can go back 10 years in figuring child support arrearages if there has been a judgment ordering the payment of support. Since there was never a judgment, there are no arrearages owed. A 30 year old cannot now come in and ask for support. It sounds like the young person may simply want to find their bio dad, or may need medical information from the bio dad. If the mother and child were receiving some sort of government assistance, you should seek advice about whether the state might try to recoup the money from the bio dad. That sounds extremely remote, but you should check into it to be on the safe side.
