custody by notary

Can my ex-boyfriend (father of my two sons) and I draw up custody papers and take them to a notary to be signed and it be legally binding? In other words, if we have these papers notarized, can he decide in a few months (or years) that, on his visitation weekend, he doesn't want to let me take them home?

Yes, the father can do this. The only way your agreement is binding is if it is approved by a court with jurisdiction.

A lawyer could draft up a stipulated judgment, have a judge sign it and file it in the court. That would be binding in all 50 states & U.S. territories. The cost would probably be much lower than you think.
