I have been separated for 2 years. My girlfriend and I have a baby and have been living together for 2 years. We met after our separation. My spouse and I separated because of irreconsilible differences. Is my spouse gauranteed spousal support in the state of Louisiana because of this situation?

Fault does play a part in support determinations, in that if your wife is not "fault-free" then she gets no support even if she needs it. You should file for divorce because there are many things that can come back to bite you.

Spousal support is not based on the payor's fault. It is based on the payee's relative need.
