I am married but separated for more than two years. I have a baby which is not his baby but because of our legal marriage status my baby last name is under his name..can I have him pay child support?

Yes you can. But if he never knew about the baby, then he can disavow. Why would you want someone who is not the father pay money? Be carefull because if you are expecting someone else to support your child, even if he is only the legal dad, then the authorities may get involved. Where is the REAL DAD??!! HE should be paying. But of course we all know he is a BUM!

An addendum to my previous answer.........he may ask for custody and can prove he is more fit.
