Legal Question in Family Law in Louisiana

What do I do?

My ex and I want to go meet with a mediator instead of a lawyer to work out child custody and support. We both agree to the terms. Can we just make an appointment to meet with a mediator in our parish and then file it with the court? How does it work? We know what we want and agree to everything. We just want it done legally.

Re: What do I do?

Dear LawGuru Friend,

Sure! Nothing wrong with what you propose. Of course, somebody will have to prepare a joint petition setting forth what you and she agree on, and a proposed judgment for the Judge to sign off on. If you need any help, let me know; I'll be glad to prepare it for you on a PRO BONO basis, if you and she can reduce to writing what you and she have agreed upon with the Mediator. Frankly, the Mediator will probably reduce to writing what you two agree upon and have you both sign off on it. Then it's just a matter of presenting a joint petition to the Court and having the District Judge sign a Consent Judgment(that you two will prepare and present). You make me wonder why, if you and she can be so agreeable, why you can't work out your marital differences; but then that's not a legal matter, and I suppose as a lawyer I should not be getting into that. Good luck to both of you!

Sincerely,

Hardy Parkerson, Atty.
