Half-Hearted Attorney

Our attorney has been acting as mediator for several homeowners following Hurricane Rita. Several have settled but we have not, and the insurance provider has made a final offer which our attorney is very angry with us for not accepting, 60% of policy limits. We want to take the case to trial if necessary but we doubt very much if we will get the representation deserved given her attitude. Our case is very strong considering the insurer has paid 100% for the loss of our garage,(not questioning if it was wind or water) but a very small amount on the actual dwelling. We've been waiting 2 years to settle this, we lost an SBA loan due to deadlines, and are now experiencing medical costs due to a stress related mental condition. Our attorney says our case has been filed with the court but no date has been set, and we paid the filing fees. She is now demanding 10K for expert witnesses and research, plus her 1/3. Do you suggest we hang in there with her, or seek another attorney? The deadline for filing Rita claims is in 3 weeks, how can we find out if we're on the docket? Thanks in advance for your input.

You need to at least speak with another attorney. There seems to be an obvious conflict if I am reading your question correctly. I will be happy to speak with you about this.
