Legal Question in Employment Law in Louisiana

Mr. Demmons - in response to a query regarding non-solicitation agreements in Louisiana, you stated that Louisiana law does allow for a non-solicitation agreement. My question is, if the contract does not state a specific time period, how long is that enforceable? We have a non-solicitation agreement with some of our subcontractors who are still providing service to our customers, and they are attempting to appropriate our customers, stating that the contract was signed more than XX years ago. We believe that the time frame is on-going and the clause is enforceable as they are still performing work for us. If they cease working for us, how long with the non-solication agreement be upheld by Louisiana law? Which statute applies here? Thank you.

These types of agreements can only stand for three years.
