Legal Question in Personal Injury in Louisiana

Wal-Mart chemical spill

There was a some kind os spill in the store. The store was evacuated and we were advised by hazmat, parimedics and the store manager to go to the hospital. We were told it would be covered by their store. The claims department denied the claim and won't pay. What can we do?

Re: Wal-Mart chemical spill

The incident that you describe is almost certainly an "accident" within the contemplation of the Louisiana worker's compensation laws. As such, the cost of all medical care should be covered. A demand letter should be directed to the store insisting that the claim be covered under worker's compensation. If the store declines, the followup procedure is to file a Form 1008 claim form with the Louisiana Office of Worker's Compensation.
