Legal Question in Real Estate Law in Louisiana

separate property

My mother took out a personal loan and purchased some property while she was married. Only her name listed as a single woman is on the deed. She is now deceased. I am her only child. Who does this property go to?

Re: separate property

Whatever interest she has in the property goes to you if there is no will. During the marriage, income and debts incurred are presumed to be community property, thereby being 1/2 hers and 1/2 her husbands. So if she were not divorced and the property divided then, you may have a cloud on the title to that property. You need to see an attorney to discuss the details.
