Legal Question in Social Security Law in Louisiana

Disability benefits

Hi,

I am an immigrant and i have been in USA for almost 4 years now. I was working as a cashier until now..but recently my health has deteriorated and i have developed some heart problem due to which i've been unable to work. According to the doctors keeping my job will just worsen my health. I have 2 dependants and i am 56 years old. Is there any way i could leave my job and be compensated by the social secuirty for my monthly expenses? If yes...how much does it cover?

Dear Law Guru Friend,

I suggest that you go ahead and apply for Social Security benefits. The sooner you apply, the sooner you will get an answer to your question, and the sooner you can begin to receive benefits, or the sooner you can begin the appeals process if you are denied. Of course, you have to make the decision as to whether and when to quit working. If you quit working before you begin to receive benefits, you are without income. As I try to indicate, no one has ever received Social Security benefits who has not made an application for such benefits. I am not saying you are entitled to such benefits, but you will never get them if you do not apply. I wish I could give you a better answer than this, but I would need more facts to work on. As I see it, you have only sixteen quarters of credits into the Social Security system. Looks to me like what you might be entitled to receive is S.S.I., not full Social Security benefits.
