If a person stops at an accident to render help then leaves the sence can that person be charged with hit and run when that person did not hit anyone or anything and there was not bodily injury?

There is no specific law that prohibits your son from testifying. The judge may determine whether or not he is able after talking to him for a bit. As to the DA and PD subpoenaes, that is ok, it is not against the law. They just both want you there to testify.
