Reckless Operation of a Motor Vehicle

I received a citation a few weeks ago of a reckless operation of a motor vehicle. What happend was, I was driving home from getting something to eat. The road along the way to my apt has bumps and potholes. I swerved to avoid a bump and lost control of my vehicle and ended up in the canal and was taken to the emergency room by paramedics which later that night I was cited. No alcohol or drugs were involved. What should I do?

You should fight the ticket. It sounds as if you have a very valid defense (and one which any Judge that lives in New Orleans will understand). A careless operation charge is very serious. It is second only to DWI in the amount of the fine that can be charged. Your insurannce premiums will skyrocket if you are found guilty of careless operation(assuming you policy isn't dropped completely). Fight that ticket!

You can always represent yourself, but I would seriously recommend hiring an attorney. The money you spend on attorney's fees will be worth it in the end to protect your driving record and insurance premiums.

If you do represent yourself, you will need to gather all the information you can, such as photos of the scene, documenation on your insurance, the accident report, the arrest report (if any), medical records, etc.
