Legal Question in Traffic Law in Louisiana

Traffic ticket

I received a speeding ticket for 86 mph in a 55 mph zone. I am not sure what to do! I have never had a ticket. Please give me any advise possible you can! What are the possible fines / jail time? Thanks a million.

Re: Traffic ticket

You are not looking at any jail time, but you are looking at a hefty fine if you are found guilty. Additionally, your insurance rates will almost certainly skyrocket if you are found guilty. You may even be cancelled by your insurance company for being found guilty of exceeding the speed limit so much.

Your alleged speed is so high that it is beyond the scheduled fines. That means that, if you are found guilty, the Judge will have to set your fine and it will be hefty.

Since you are accused of going 31 miles over the speed limit, you may also be accused of Careless Operation of a Motor Vehicle ("COMV"). Look at the ticket and see if there is more than one violation charged. If there are two, one is likely COMV, sometimes called Reckless Operation of a Motor Vehicle ("ROMV") or just "reckless driving". That fine for COMV is also a serious one. COMV is the most serious charge in traffic court, aside from DWI/DUI.

You should seek representation. There are likely several attorneys who regularly practice in traffic court in the parish where you were stopped. Do an internet search for some, or look on here. Not all lawyers handle traffic matters, because the money is not great for a lawyer, so you may want to add "traffic ticket" or something like that to your search. Expect to pay a couple of hundred dollars for the representation, but it is money well spent if the attorney can reduce or eliminate the fines and blemishes on your driving record.

Re: Traffic ticket

Hire a lawyer and let him work the DA to get you a lower fine or none at all.
