Legal Question in Wills and Trusts in Louisiana

disbursing of property

Can we disburse of the contents of my deceased mother's home before we see a lawyer? She left a will splitting it all four equal ways. We all agree with splitting it equally. It's not much. Just the house and it's contents. House worth less than $100,000.00.

Re: disbursing of property

Technically, the answer is no. The contents should be inventoried and valued, and distributed as a part of the probate process.

As a practical matter, though, since there will be no inheritance taxes (assuming that all the property is located in Louisiana), and if everyone agrees on who will receive what, and everyone signs a receipt acknowledging what they have received and that it represents a fair distribution, it is a practical and efficient way to dispose of the contents.
